Terms of Service Book Covers Art

 

These Terms of Service, when agreed to and accepted by you (the Client) after you enter your full legal name and click “I have read and accept the Terms of Service,” will create a binding and legally enforceable contract between you (the Client) and Ivan Zanchetta (the Designer/Book Covers Art). Please read these terms and conditions carefully before submitting your form.

1. Designer Responsibilities

1.1 I am committed to delivering a one-of-a-kind e-book cover and optional add-ons designed according to the Client’s wishes.

1.2 Cover design refers to the visual appearance of the front cover of the book. For pre-made, custom, and illustrated covers, the paperback add-on includes a front cover, spine, and a back cover designed with a complementary texture or gradient. The front cover artwork will not seamlessly extend to create a full wrap-around design on the back cover unless a full wrap-around artwork is specifically purchased.

1.3 If you choose the Full Wrap option, I will extend the front cover artwork background to create a continuous design that covers the spine and the back cover. This option applies only to the background elements of the scene — it does not include adding new illustrated objects, characters, or complex details. If you need additional elements on the back cover, this will require a custom quote. Final wrap dimensions must be provided by you (including trim size and page count) before I can deliver the print-ready file.

1.4 I am committed to creating original designs and will never knowingly infringe upon the copyright of other designers' work. Should a Client request a design that mimics an existing style or element for which express permission has been granted, the Client is solely responsible for providing verifiable proof of such permission. For series continuations, I will work to maintain visual consistency while ensuring all elements are legally sourced or created.

1.5 The Custom Cover Package and Illustrated Cover Package include three (3) revision rounds during which the Client may request reasonable design changes without additional fees.
A “revision round” is defined as a set of consolidated feedback provided by the Client in response to a delivered draft.
Once the included revision rounds have been completed, any additional revisions, changes, or new requests will be billed at an hourly rate of $60 USD, with a minimum charge of one (1) hour per revision request.
Minor adjustments to title and text elements (such as wording, formatting, or positioning) are not counted as revision rounds, provided they remain within reasonable limits. Excessive or repeated text changes may be treated as additional revision work and billed accordingly.
Requests that significantly alter the original brief, creative direction, or approved concept are not considered revisions and will require a separate quote.

1.6 The Pre-made Cover Package includes one review round for textual changes without additional fees. Subsequent individual changes will incur a $30 fee each.

2. Files Delivered

2.1 Artwork will be delivered in JPG format for e-book covers and in PDF format for printable covers. All other optional add-ons will be delivered in PNG or JPG format. Fully layered PSD source files are not provided under the standard agreement. However, fully layered PSD files may be available under a separate, negotiated licensing agreement to comply with copyright and sub-licensing regulations.

3. Publishing Rights

3.1 For client-provided images used in the project, the Client acknowledges they have obtained all necessary rights and permissions to publish the materials and will be solely responsible for the validity of copyrights, trademarks, and ownership claims. The Client agrees to indemnify, hold harmless, and defend the Designer from any copyright or permission infringement actions resulting from the materials provided. The book material provided must not be a public domain work unless the Client is the original author.

4. Confidentiality

4.1 All Client information and materials are considered confidential and will be used exclusively by the Designer to provide a quote or complete the project. Client information and project materials will not be disclosed or shared with any third party unless otherwise requested by the Client.

5. Ownership Rights

5.1 Upon receipt of full payment, the Designer grants the Client an exclusive license to use the final cover design artwork (PDF, JPEG, or other publishing-ready format) for their e-book cover and associated optional add-ons.
5.2 The Client understands that they have no right to alter the final cover design except to change size for printing or digital display. The image, title, layout, and all graphic elements on the cover are copyrighted and are the property of the Designer and cannot be used without explicit permission. Only logos, trademarks, and other graphic materials provided by the Client are excluded. The Client must consult the Designer for any alterations, which may incur additional fees.
5.3 The Designer uses their own images or stock images purchased from various sites. These stock image sites have different license terms, usually allowing use up to 250,000 or 500,000 printed copies, with unlimited digital impressions. The Client must inform the Designer if they need to extend such a license and will be directed where to purchase the related licenses. The Standard License for stock images permits digital promotional use but restricts physical product creation without an Extended License. Fully original illustrated covers have no printing limits.
5.4 The Designer retains the right to use the Client’s final and draft book cover designs, name, and book title in my portfolio to market and promote my services. The Designer retains copyright and ownership of all design and draft materials.
5.5 If the Client provides materials subject to intellectual property rights by a third party, they must secure appropriate rights before incorporating them into the project. The Client assumes full legal and financial responsibility for any intellectual property disputes involving provided materials.

6. Attribution

6.1 Attribution is optional but appreciated. Suggested attribution: “Cover Design by Ivan Zanchetta & Bookcoversart.com” (with a working link) or “Cover Art by Ivan Zanchetta & Bookcoversart.com” (without the link). A small and discreet credit on the back of paperback covers can be removed upon request.

7. Client Responsibilities

7.1 Any changes to the original brief after work has commenced, including shifts in creative direction or repeated revision requests beyond the included rounds, may result in additional charges and extended timelines.

7.2 The Client is fully responsible for proofing the book cover design provided by the Designer. It is strongly suggested to request a printer's proof before ordering any materials using the provided designs. The Designer will not be held financially or legally responsible for any issues arising from the use of the provided materials.

7.3 If you choose the Priority Start option, I will schedule your project as a priority and begin work within 5 business days of receiving payment. This option covers early project initiation only and does not guarantee a fixed delivery date. Completion times may vary depending on the complexity of the project and the timeliness of your feedback. If you request excessive or repeated revisions, delay in providing feedback, or change the project scope, the overall timeline may be extended. I also reserve the right to limit revisions as outlined in our original agreement.

7.3a Priority Start Availability - Priority Start requests are subject to availability. I can only accept a limited number of Priority Start projects within the same period. If multiple clients purchase this option at the same time and I cannot reasonably schedule them all, I reserve the right to reschedule based on project feasibility. In such cases, you may either accept the revised schedule or receive a full refund for the Priority Start fee.

7.3b Priority Start Fee - The Priority Start fee is non-refundable once I have confirmed your project in the priority schedule. If I am unable to accept your Priority Start due to availability limits, I will notify you promptly and refund the Priority Start fee in full. If the Priority Start option was essential to your project and you choose not to proceed without it, you may cancel your order without penalty and receive a full refund of any payments made.

7.4 If I am on vacation or otherwise unavailable — which will always be clearly announced on my website — the 5-business-day timeframe for Priority Start will start only after my return. By placing an order during these periods, you acknowledge and accept this adjusted scheduling.

8. Liability

8.1 The Designer is not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, related to my services. The Designer is not responsible for any claims, losses, or injuries based on errors or inaccuracies on my site or in client documents, including breaches of these terms and conditions.
8.2 The Designer guarantees the use of legally sourced assets to the best of my knowledge and ability. Should questionable stock be used, the Designer agrees to edit or refund any affected artwork.

9. Payment

9.1 For custom and illustrated covers, a 50% deposit is required in advance, with the final payment due before final file delivery. For pre-made covers, payment is due in full at the time of ordering.

10. Cancellation Policy

10.1 Either party may terminate this agreement by providing written notice.

  • If the Designer initiates the cancellation prior to the commencement of the design process, any payments received will be refunded in full.
  • If the Client cancels the agreement before the design process begins for any cover type (Custom, Pre-made, or Illustrated), a cancellation fee of $10 or 10% of the total order amount, whichever is greater, will be deducted from the refund.
  • Once the design process for a Custom or Illustrated cover has begun (e.g., after the initial concept work, or for illustrated covers, after the sketch is approved and the final illustration process has commenced), no refunds will be issued under any circumstances, as work will have begun on a highly customized product.
  • For Pre-made covers, once the initial text changes have been applied and sent to the Client, the sale is considered final and non-refundable.

11. Complete Agreement

11.1 This agreement constitutes the entire agreement between all parties. No additional promises or conditions, written or oral, apply unless included herein.

12. Modification of Agreement

12.1 Modification of this agreement is valid only if confirmed in writing and signed by all parties.

13. Severability

13.1 The invalidity or unenforceability of any provision of this agreement does not affect the validity or enforceability of the remaining provisions.
